Terms of service.

These terms are between you and Dusty Bushwhackers LLC and govern our respective rights and obligations.

 

Dusty Bushwhackers  is licensed and insured. Please note that your use of any Dusty Bushwhackers  services are also governed by our conditions of use and privacy notice, if you sign up with me, you accept these terms, conditions, limitations and requirements. Please read these Terms carefully.

 

SERVICES: I will perform all the services provided during our quoting process. Your scheduled visit date will appear on your monthly invoice. Every scheduled visit will be performed unless notified otherwise. Schedules are set to maximize performance; due to uncontrollable conditions such as weather and traffic we cannot specify an exact time of service and we reserve the right to change the scheduled date.

Note: Some of our services, such as mowing, Leaf Removal/Clean -Up are seasonal and might not be performed in the dormant season. Please contact us at least 48 hours prior to your scheduled visit if you have specific requests.

 

INVOICING: Your bill for all jobs and maintenance are due upon receipt. We accept most major Credit Cards: Visa, MasterCard and Discover ( Via Stripe). You will be required to place a credit card on file. I will send you a link via text message or email in order to set up your credit card on file through our partnered service. The outstanding balance is due in full by due date. A $25.00 late fee will be charged per month if payment is not received within 7 days. I may, in my discretion, accept partial payments, please contact me for more details. I reserve the right to suspend or cancel our services until payment is received. Services will be terminated if full payment is not received within 60 days after date of invoice. Any payments returned by the issuing institution will be charged a processing fee of $35. I do not offer refunds for services that have already been performed. Each year the price of my services can be subject to an increase, I will advise you if your monthly price increase. If you have a bill discrepancy, you should notify me within 7 business days after the receipt of your invoice. I offer invoices to be either emailed or texted to your mobile device for your convenience. CLIENT’S RESPONSIBILITIES: Client agrees to pay the charges specified prior to service. Client is not required to be at home while service is performed but the service area must be accessible and free of obstructions (lawn furniture, toys, trash, bio-hazardous materials, etc.) prior to the scheduled visit. All pets must be secured as to pose no threat to me servicing your property . If I find obstructions, I will service what we have access to and you will be charged for a full service. I will not be responsible for damaging any unsecured cables, wires, irrigation pipes or heads, lines etc., which are not installed deeper than 3" below ground level.

 

TERMINATION OF SERVICES: Services can be cancelled without penalty with 15-day email notice from either party before services are provided. Please send such notice by email or text. Account must be paid in full prior to cancellation date. Termination does not remove your responsibility to pay all fees or costs in collecting any past due amounts, including costs of attorneys or a collection bureau, those fees and costs will be added to your balance. I may, in my discretion, accept a 30-day or immediate cancellation notice for the following reasons* : You or your spouse are active military and transferred out of the local area, you sell your property, unemployment, sickness and/or death. (*I may ask for proof for early cancellation). A termination fee may apply if cancellation notice is not given.

 

CANCELLATION OF VISITS: 2 day notice is required for cancellation of a scheduled visit. Scheduled visits will be charged a $15 service fee if 2 day notice is not given. Failure to notify prior to scheduled visit will result in additional fees if client notifies me on or enroute to your residence.

 

NOTICE OF DAMAGE: Client must notify Dusty Bushwhackers within 48 hours of any damages caused while performing work (via phone call for minor problems and email for more serious issues). In most cases, I will address the problem within two to five business days after receiving client’s request. In some cases it may take longer, depending on circumstances beyond lawn care professional’s control (such as, but not limited to: weather).

 

SATISFACTION: If for any reason, you are not 100% satisfied with your services, please contact me within 24 hours to resolve the issue. I pride myself on exceeding our clients’ expectations and I want to keep communication open.
